1. Acceptance of Terms

Welcome to 1Throttle (the "Platform"), a listing-based marketplace built for Harley-Davidson enthusiasts. By accessing or using the Platform — including browsing listings, creating an account, or subscribing to a paid plan — you ("User," "you," or "your") agree to be bound by these Terms & Conditions ("T&C"). If you do not agree to these T&C in full, you may not access or use the Platform. 1Throttle reserves the right to update or modify these T&C at any time. Continued use of the Platform after changes are posted constitutes your acceptance of those changes.

2. About 1throttle

1Throttle is a listing-based online platform that connects sellers and buyers of Harley-Davidson related parts, accessories, and motorcycles. The Platform does not hold inventory and is not a party to any transaction between users. We offer both free and paid plans, including tiered packages with expanded listing limits and additional promotional features. Full plan details are available on the Platform and may be updated periodically. These Terms & Conditions may be revised from time to time. Your continued use of the Platform after any changes are posted constitutes acceptance of the updated Terms.

3. Eligibility

  • Intended Use: The Platform is primarily intended for users located in the United States. However, access may be available to users in other regions at our discretion.
  • Minimum Age: There is no strict age restriction; however, we strongly recommend that individuals under the age of 18 use the Platform only under the supervision of a parent or legal guardian.
  • Legal Capacity: By accessing or using the Platform, you confirm that you have the legal authority to agree to and comply with these Terms & Conditions.

4. User Accounts

  1. Account Creation: To list items or access certain features, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process.
  2. Account Responsibility: You are responsible for all activity conducted through your account. You agree to maintain the confidentiality of your login credentials and notify us immediately of any unauthorized use.
  3. Suspension & Termination: We reserve the right to suspend or terminate accounts that violate these Terms, post prohibited content, engage in suspicious activity, or for any other reason at our sole discretion — with or without prior notice.

5. Listing Items

  1. Free Listings: 1Throttle currently offers both free and paid plans. The Free plan includes a limited number of listings, while paid plans (such as Standard, Professional, and Business) provide additional features and higher ad limits. Plan details and pricing are available on the Platform and may be updated from time to time.
  2. Listing Requirements: You must accurately describe each item you list, including condition, model year, and any other relevant information. Personal contact details (such as email addresses, URLs, or social media handles) are not allowed in the title or description. If you choose to share contact information, use the designated fields provided by the Platform (e.g., phone number).
  3. Prohibited Content: You agree not to list items or post content that:
    • Is unrelated to Harley-Davidson motorcycles, parts, or culture (unless explicitly permitted in future platform updates).
    • Is illegal or restricted by applicable law.
    • Contains pornographic, sexually explicit, or otherwise adult content.
    • Promotes violence, hate speech, or discrimination of any kind.
    • Is false, misleading, deceptive, or fraudulent.
    • Infringes on copyrights, trademarks, or other intellectual property rights.
  4. Right to Remove Listings: 1Throttle reserves the right to remove, edit, or restrict any listing that violates these Terms or is deemed inappropriate, misleading, irrelevant, or spammy. We may do so at our sole discretion and without prior notice.

6. User-Generated Content

  1. Ownership: You retain full ownership of any content you submit or post on the Platform, including text, images, or other materials ("User Content"). By submitting content, you grant 1Throttle a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute your User Content solely for the purpose of operating, promoting, and improving the Platform.
  2. Content Standards: You represent and warrant that you have all necessary rights and permissions to post the User Content, and that it does not violate any laws or infringe upon the rights of any third party.
  3. Prohibited Content: 1Throttle does not allow content that is hateful, defamatory, obscene, illegal, or otherwise harmful. We reserve the right to remove such content and may suspend or terminate accounts involved in violations — with or without prior notice.

7. Transactions Between Users

  1. Independent Parties: 1Throttle is a listing-based platform only. We are not a party to any transaction between users. All sales, purchases, and communications are strictly between the buyer and seller.
  2. Payments & Shipping: Buyers and sellers are responsible for coordinating payment and shipping independently. 1Throttle does not currently provide integrated payment processing, escrow services, or shipping tools.
  3. Disputes: All disputes regarding pricing, quality, payment, delivery, returns, or warranties must be resolved directly between the involved parties. 1Throttle assumes no responsibility or liability for any issues or damages arising from user-to-user transactions.
  4. User Reviews & Ratings: At this time, 1Throttle does not host a native review or rating system. However, select paid plans include the ability to display verified Google reviews using a widget integrated into your user profile. This feature is set up manually by our team and typically activated within 1–2 business days after your plan begins. Instructions will be provided by email to guide you through connecting your Google Business account.

8. Reporting Inappropriate or Illegal Content

  1. Report Feature: Users can report a listing if they believe it violates platform guidelines. The available report reasons include:
    • Not Harley-Davidson Related
    • Wrong Category
    • More Items Shown Than Being Sold
    • Misleading or False Information
    • Suspicious or Scam Listing
    • Violation of Marketplace Rules
  2. Follow-Up: All reports are reviewed by the 1Throttle team, typically within 48 hours. Reports can be submitted anonymously, and if a listing is found to be in violation, appropriate action will be taken — including possible content removal or account restriction.

9. No Affiliation with Harley-Davidson

1Throttle is an independent platform and is not affiliated with, sponsored by, or endorsed by Harley-Davidson Motor Company. References to Harley-Davidson and its products are used strictly for identification and categorization purposes. Users are solely responsible for ensuring that their listings and content comply with applicable trademark laws and brand usage guidelines.

10. Liability & Disclaimers

  1. As-Is Platform: 1Throttle is provided on an "as is" and "as available" basis. While we strive for quality and uptime, we do not guarantee uninterrupted access, error-free performance, or full platform security.
  2. No Warranty: To the fullest extent permitted by law, 1Throttle disclaims all warranties — express or implied — including warranties of merchantability, fitness for a particular purpose, and non-infringement.
  3. Limitation of Liability: In no event shall 1Throttle, its owners, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages — including, but not limited to, loss of profits, data, or revenue — arising out of or related to your use of the Platform.
  4. Third-Party Content: The Platform includes listings and content submitted by users. 1Throttle does not guarantee the accuracy, reliability, or legality of this content and assumes no responsibility for user-submitted materials.

11. Termination

  1. Immediate Termination: We reserve the right to suspend or permanently terminate any account that violates these Terms & Conditions, contains prohibited content, or is engaged in suspicious or fraudulent activity — with or without prior notice.
  2. Notice: Where feasible, we will notify affected users by email if their account has been flagged or terminated, along with the reason for such action.

12. Governing Law

These Terms & Conditions shall be governed by and interpreted under the laws of New Zealand, where 1Throttle is legally registered and operated. While the Platform primarily serves users in the United States, we aim to comply with applicable U.S. e-commerce and consumer protection regulations where relevant. However, any disputes or claims arising from the use of the Platform shall be subject to the exclusive jurisdiction of the New Zealand courts, unless otherwise required by applicable local law.

13. Changes to These Terms

1Throttle may update or modify these Terms & Conditions at any time. Any changes will be posted on the Platform and take effect immediately upon publication. Continued use of the Platform after such updates constitutes acceptance of the revised Terms.
